On Monday, social media influencer Gcinile Twala's name surged to the top of trending lists following the leak of an intimate video featuring her and her ex-fiance, Themba "Grootman" Selahle. The explicit footage, allegedly leaked by Grootman, has rapidly gone viral, bringing the issue of revenge porn into sharp focus.
Revenge porn, defined as the distribution of sexually explicit images or videos without the consent of the individuals involved, is a serious and growing concern. The non-consensual release of such material, often created during an intimate relationship, can have devastating consequences for the victims.
The Citizen interviewed social media law specialist Emma Sadleir to discuss the legal ramifications of distributing private sexual content without consent. Sadleir emphasized that in South Africa, such actions constitute a grave criminal offense.
"The non-consensual distribution of private sexual photos or videos is a very serious criminal offense in South Africa," Sadleir stated. She co-authored "Don't Film Yourself Having Sex," a book addressing the potential social and legal pitfalls in the digital age.
Historically, South African law handled these violations under the crime of crimen injuria, which covers serious infringements on a person's dignity due to content publication. However, recent legal developments have introduced more specific legislation to combat revenge porn and image-based abuse.
