(4) * Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Scooper or any of Scooper’s providers or any other third party (including another user) to protect the Services or its Content (“Content”);
(5) * Attempt to access or search the Services or Content or download Content from the Services through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by Scooper or other generally available third-party web browsers;
(6) * Use any meta tags or other hidden text or metadata utilizing a Scooper trademark, logo URL or product name without Scooper’s express written consent;
(7) * Use the Services or Content, or any portion thereof, for any commercial purpose or for the benefit of any third party or in any manner not permitted by these Terms;
(8) * Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Services or Content to send altered, deceptive or false source-identifying information;
(9) * Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Services or Content;
(10) * Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Services;
(11) * Collect or store any personally identifiable information from the Services from other users of the Services without their express permission;

Upon a request by Scooper, you agree to defend, indemnify and hold harmless Scooper and its affiliates, directors, officers, employees and agents against any claims, demands, actions, damages or other liabilities, including expenses and attorney’s fees, that arise from your use of this Web site or App. Scooper reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Scooper in asserting any available defenses.
These Terms and any action related thereto will be governed by the laws of the People's Republic of China without regard to its conflict of laws provisions.
Any dispute or controversy arising between you and us shall first be resolved through friendly negotiation. If negotiation fails, you agree that the dispute or controversy shall be submitted to China International Economic and Trade Arbitration Commission, Beijing, China, for arbitration in accordance with its Rules of Arbitration .
8.1 Rights in App Granted by Scooper
Subject to your compliance with these Terms, Scooper grants you a limited non-exclusive, non-transferable, non-sublicenseable license to download and install a copy of the App on a mobile device or computer that you own or control and to run such copy of the App solely for your own personal non-commercial purposes. You may not copy the App, except for making a reasonable number of copies for backup or archival purposes. Except as expressly permitted in these Terms, you may not: (i) copy, modify or create derivative works based on the App; (ii) distribute, transfer, sublicense, lease, lend or rent the App to any third party; (iii) reverse engineer, decompile or disassemble the App; or (iv) make the functionality of the App available to multiple users through any means. Scooper reserves all rights in and to the App not expressly granted to you under these Terms.
8.2 Additional Terms for App Store Apps
If you accessed or downloaded the App from any app store or distribution platform (like Google Play or the Amazon Appstore) (each, an “App Provider”), then you acknowledge and agree that:
1. (1) * These Terms are concluded between you and Scooper, and not with App Provider, and that, as between Scooper and the App Provider, Scooper, is solely responsible for the App.
2. (2) * App Provider has no obligation to furnish any maintenance and support services with respect to the App.
3. (3) * App Provider is not responsible for addressing any claims you have or any claims of any third party relating to the App or your possession and use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
4. (4) * In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Scooper will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by these Terms.
5. (5) * You must also comply with all applicable third-party terms of service when using the App.
6. (6) * You agree to comply with all U.S. and foreign export laws and regulations to ensure that neither the App nor any technical data related thereto nor any direct product thereof is exported or re-exported directly or indirectly in violation of, or used for any purposes prohibited by, such laws and regulations. By using the App you represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
As a resource to Our users, Our Web sites or Apps may provide links to other sites. However, because Scooper does not control the content of these other sites We may link to, We cannot be responsible for the content, practices or standards of third party sites. Inclusion of any third party link does not imply a recommendation or endorsement by Us. We are not responsible for and will not have any liability for any damages or injuries of any kind arising in connection with the content of linked third party sites, sites framed within Our Web sites or Apps, or third-party advertisements. We do not make any representations regarding the content or accuracy of third-party sites. Your use of third-party sites is at your own risk and subject to the terms and conditions of use for such sites.
We do not warrant that the App will be compatible or interoperable with your mobile device or any hardware, software, equipment or device installed on your mobile device or used by you to access and use the mobile application in connection with your mobile device (“Accessories”). You acknowledge that compatibility and interoperability problems: (a) may cause the performance of the App, your mobile device and any Accessories to diminish or fail completely; (b) may result in permanent damage to your mobile device and any Accessories; (c) may result in a loss of data on your mobile device or Accessories; or (d) may result in the corruption of software and files located on your mobile device and any Accessories. You acknowledge and agree that Scooper shall have no liability to you for any losses suffered resulting from or arising in connection with compatibility or interoperability problems.
If any provision of this Agreement is unlawful, void or unenforceable, you agree that the provision will be enforced to the maximum extent permissible and the remaining provisions contained in this Agreement shall continue in full force and effect.
We reserve the right to make additions, deletions, or modifications to these Terms of Service at any time without prior notification.
